Was it civil of the Gov to declare a civil emergency?

Partisan lines were quickly drawn when Gov. Paul LePage declared a civil emergency in response to the government shutdown. Was the governor justified and/or was the reaction overblown? Why did the Governor only brief Republican legislators and no Democrats about his decision?
